Agreement has still not been reached over the purchase of an access road crucial for the new Stanley Park High School to open.

The road, which would link the school to Woodmansterne Lane, was required as a condition of the planning permission but the council has been unable to reach agreement with the Benhill Gospel Trust.

After three years of negotiations with the trust, the council decided to begin the £38m build in June without agreement over the road.

A spokeswoman said the council was confident of reaching an agreement or securing a compulsory purchase order (CPO) from the courts.

But the ongoing negotiations have not been successful and on November 30 Sutton Council's executive committee will consider applying for a CPO.

Councilor Kirsty Jerome, Executive Member for Education and Schools on Sutton Council, said: "We are proceeding with our negotiations with the Benhill Gospel Trust so that we can reach an amicable agreement on a road that is beneficial to all involved but it is right for us to consider the use of a compulsory purchase order should an agreement not be reached."

The new school will provide a seven form entry school with 350 sixth form places and 91 places for children with autistic spectrum disorders.
