The death of a cricketer who was chased by police shortly before dying on the tube track in Wimbledon Park, will not be investigated by the police complaints watchdog.

Surrey batsman Tom Maynard, who lived in Wandsworth, was killed yesterday morning by a District Line train at Wimbledon Park, after he was stopped by police for driving a black Merecedes "erratically" down Arthur Road.

After being stopped on nearby Ryfold Road at 4.13am, hhe fled on foot and evaded officers, police said, before he was found dead at just after 5am.

In a statement this afternoon, the Independent Police Complaints Commission (IPCC) said they will not investigate the death as Mr Maynard was not in contact with police when he was killed by the train.

The watchdog said the matter had been referred back to the Metropolitan Police and that a formal inquest will determine the circumstances surrounding Mr Maynard's death.

A spokeswoman said: ""The police evidence is that at 4.13am officers saw a car being driven erratically which they followed.

The driver then decamped and, after a short chase on foot, officers lost sight of him and had no further contact.

"The man appears to have been hit by a train at 5.04am. In the circumstances the IPCC has referred this matter back to the MPS.

"British Transport Police will prepare a file for the coroner."
